IRB looks at DEMPEDEMPE - who actually develops, enhances, maintains, protects, and exploits the intangible. "Fair price" doesn't mean one exact number - it means falling inside a statistical band built from comparable companies. Malaysia's rule is more specific than the "interquartile range" many other countries use: the arm’s length range独立交易区间 is defined as the values sitting between the 37.5th and 62.5th percentile of your comparable companies' data set.「公道价格」不是指某一个精确数字,而是要落在一批可比公司数据算出来的统计区间里。大马的规则比很多国家用的「四分位距」更窄更具体:Arm’s Length Range独立交易区间的定义,是从可比公司的数据组里,取第 37.5 到第 62.5 百分位之间的数值。
Land inside the green-dark band and your pricing is generally accepted; fall outside it and IRB can adjust you to the median.落在深色区间里,价格通常会被接受;落在区间外,IRB 可以把你调整到中位数。
This is exactly why a benchmarking study can't just be "roughly similar to industry norms" - the range is a precise statistical calculation, and it directly decides whether IRB accepts your pricing or adjusts it (and taxes you more) on the spot.
